QUESTION

agister lien

Asked on Mar 09th, 2015 on Agricultural Law - Ohio
More details to this question:
I have an automatic lien on a horse when I am contracted for care. Recently a boarder entered my property and removed their horses knowing and admitting they owed me money and after being told they were not to. They came when they knew I wouldn't be there. From what I have found in the ohio codes it us a jailable felony to remove, damage, etc... that is in the possession of the lien holder. I want them arrested. I know I can sue them in civil court but what about the "breaking the law " part. My local sheriff department is unsure how to react..... ask five different deputies and u get five different answers. Can u explain to me if I can press charges?????

Taking his own property is not theft but you do have a claim on the horse and for breach of contract. You may also have a trespass claim.
