QUESTION

Can I sue a commercial cat breeder?

Asked on Dec 15th, 2017 on Animal Law - Florida
More details to this question:
A commercial cat breeder sold me a 1,600 kitten that died 5 days after purchase. She lied about the kittens birthdate, I called the vet she was taken to for initial shots and the breeder said she was Born on Sept 28—she told me she was born October 1st. The kitten died of parvo and the breeder did vaccinate her, however, she took her to get the vaccine 4 days after it’s recommended. It is recommended that kittens get the parvo vaccine at 6-8 weeks of age, but she took the kitten at 8 wks, 4 d of age. The other problem is that I have 3 newborn kittens in my home That will now possibly get parvo as well from being exposed to this sick kitten I purchased. It is HIGHLY contagious. I took my 3 kittens to the vet today because the new kitten passed away last night in the emergency room, and the vet said they are still healthy and have no parvo, but there’s a huge chance they might show signs of parvo in 2-10 days due to the seriousness of the disease. Please advise. Thank you.

Sure. Its possible if you want to spend the money on legal fees making the effort. There are several issues that can be addressed including the breeder statute requirements.
