What can a landlord ask for in showing proof that a service dog is actually truly a service dog for a disabled person? A potential tenant sent an application in and was approved prior to showing the property The potential tenant came and saw the property and said he wanted it and he would call back that night to confirm He did not bring a service dog and did not disclose he had a service dog until he called that night He has a 60 pound 11 year old whimera and says he has a certificate. We are well aware that anyone can get a certificate and package overnight fraudulently on the internet. What information am I allowed to prove his certificate is often is authentic ? Can he be turned down as a tenant because he was deceptive on his application and when he came to look at the property he was deceptive again by not bringing the service dog
These are very sticky issues and really need to be dealt with with a lawyer's direct involvement. Technically, you are able to ask if its a service animinal required for a disability and what services does the animal provides. Thats it. If you start asking for proof of the service aspect of the animinal you run a high risk oif gettng involved in expensive litigation under HUD/FHA andthe ADA and you better be right that it was a sham or you will pay dearly. This is why these sham doctors issue letters for people on the internet claiming thier pit bull is a service animinal or ESA.
