QUESTION

After Filing a Chapter 13 can I change to a Chapter 7

Asked on Oct 28th, 2013 on Bankruptcy - Oklahoma
More details to this question:
I'm very close to turning in all my required documents to begin filing a Chapter 13. However, there is a 50/50 chance that I may lose my current job sometime next year March timeframe. If I file a Chapter 13 and I begin making payment then I lose my employment will my monthly payments toward the Chapter 13 be adjusted or do I have to file under Chapter 7 proceedings? Will I have to pay attorney fees toward the Chapter 7?

You may have both options. A post confirmation of your chapter 13 plan may be possible if you can still make payments in a lesser amount, or conversion to ch. 7 may be possible if you meet the other eligibility requirements for a ch. 7 discharge. You should expect to have to pay attorney fees for the additional work, which may even require filing all new schedules.
