I am a single man, I just claim myself, and I filed a chapter 13 bankruptcy. I make 64,000 gross income, so I over the median to qualify for Chapter7, but because I pay so much in child support (1200 monthly), I don't have enough income to take care myself (pay rent, etc) On paper, I'm 1,000 to 1,500 in negative when we did the expense report. Can child support be used to help me meet the Chapter 7 qualification, when it comes to income?
Child support is an allowable expense on the means test. Why did you file a Chapter 13 case if you are $1,500 per month negative in your budget? What did the means test show?
This is a very complicated analysis and way beyond the scope of this forum. You need to have an experienced bankruptcy attorney analyze your situation and advise as to your options.
