We filed bankruptcy in 2009 but reaffirmed our mortgage and second mortgage on our home. We have continued to make the monthly payments on time. Shortly after the bankruptcy, we stopped receiving statements on the second mortgage. We continued to and still make the monthly payment on it. Recently, we began paperwork to purchase another home and found out that our second mortgage was not reaffirmed, (even though the credit report says it was), and our bank will not reaffirm it for us because we are apparently paying 0% interest on it. We have asked them to settle for 35% of the amount, provided we can get a financier to back us on it, which we will likely be able to do. The bankruptcy firm we used somehow seemed to disappear and all numbers have been disconnected. Is there any legal action we can take in oder to get this debt reaffirmed since we were under the impression that it was? Any advice is greatly appreciated!
Why do you want the debt reaffirmed? There is no reason to reaffirm a mortgage debt.
But to answer your question, no--you cannot reaffirm a debt after a discharge has been granted.
