I owed a landscaper $200 for a final bill that I completely forgot about. 30 days after it was due I had a harassing phone call from a lawyer for the landscaper. I NEVER received any other past due notices or anything just the call. I apologized that I had forgotten about the debt and told him I would put it in the mail. He asked for it by the 8 and was post marked the 9, a day late because my kids had the flu which I called and told him. The lawyer called me everyday harassing me leaving messages about filing criminal charges against me for the $200. I assured him it was IN the mail but he continues to call and harass me. The landscaper was paid in FULL, {cashed check} and the lawyer called me back now wanting his lawyer fees for the work he did for the landscaper. He told me if I didn't pay him for his lawyer fees he would put a mechanic lien on my property until he was paid for his legal services for the landscaper. My question is this even something I am responsible for? Keep in mind this was for grass cutting and never had a written agreement with landscaper
It depends on the state laws where you are, but it is very unlikely that the attorney fees can be part of a mechanic's lien if the base claim has already been paid.
I would report this behavior to the attorney grievance commission. You do not owe him attorney fees the other guy does. Also to threaten criminal prosecution to collect a debt is illegal.
