QUESTION

Can I be conserved for middle-aged chronic psychiatric disability?

Asked on Sep 29th, 2014 on Bankruptcy - Michigan
More details to this question:
I am what the physics trig system calls "dual-diagnosis". Meaning, I have a serious substance abuse problem co-occurring with a background condition (in my case schizophrenic psychosis). I am unable to manage my finances and legal affairs and have in fact landed myself in bankruptcy.

You would probably benefit from some sort of conservatorship or guardianship. However, once you have a conservator or guardian, you're pretty much stuck with them. You really should consult an attorney to see if it would be right for your particular situation.

Unless you are made a ward of the state and declared incompetent, you will continue to have to deal with the repercussions of what you do. Mental illness does not give you a ticket to ride all the rides at the carnival. You need to decide whether having your freedom or being a victim of your disease is more important and act accordingly.

Conservatorship is used for physically infirm adults. Guardianship is used for mentally incompetent adults. If you are mentally unable to handle your affairs, a guardian can be appointed. I would recommend that you use a person you know and trust. If you don't know such a person (as a drug user that seems likely) - find an attorney on your own. DO NOT LET THE COURT APPOINT ONE OF THE JUDGE'S CRONIES - THE LEGAL FEES WILL BE OUTRAGEOUS. Be warned, once a guardian is appointed, you're stuck with it unless you can prove you're competent.

Yes, any one close to you can file a petition to be appointed as your conservator. The Public Administrator/Guardian can also file.
