QUESTION

Can I file for bankruptcy?

Asked on Dec 15th, 2012 on Bankruptcy - Georgia
More details to this question:
My husband has owned his own business for the last year and a half. We finally thought he had two large contracts. Now we have found out that he isn't getting either contract. In addition, I have some credit card usage for the last 60 days because we never contemplated filing for bankruptcy. All of my debt is in my name and I received a summons from a past due credit card bill. Will I be denied a chapter 7 because of the credit card usage?

Depending on the amount and purpose, the prior credit card usage may present a problem. If the amount was relatively low (less than $500) and used for every day items (not luxury items) you should be able to get through. With a pending lawsuit, you need to talk to an attorney that can fully analyze your situation.
