More details to this question:
I'm preparing for a separation and I have more debt then I could ever get under control, with the separation I really want to wipe my slate clean as far credit goes. Me and my spouse have joint debt however he'll never agree to bankruptcy so I want to know my options, the shared debt is two vehicles.
If you are separated from your spouse, you can file bankruptcy on your own without needing your spouse's involvement or approval. Your eligible debts will be discharged and those creditors will not be able to collect from you.
If the vehicles are financed, then they are secured and you basically have two options. You can keep the vehicle and continue making payments on time, or you can surrender the vehicle and not have to pay any remaining balance. However, there are more considerations based upon your specific facts.
