QUESTION

Can I get a part time job during Chapter 7?

Asked on Apr 10th, 2017 on Bankruptcy - Kentucky
More details to this question:
I have filed joint bankruptcy with my husband. We are getting ready to have the meeting with the creditors next weekend. Even with bankruptcy, we are still about $100 short a month. Will this job hurt my chapter 7? At max, it would be an extra $500 a month before taxes are taken out. My other son will be out of school so our daycare cost is going up for the summer and this job would help.

If you can get a job, take it. A new job and more money will not in any way prevent you from receiving a discharge in Chapter 7.

Your bankruptcy information is processed as of the date you file. Any attempt to correct your situation after filing is okay. Getting a job to help your situation would be fine.

First things first: retain a lawyer experienced in bankruptcy practice in your locality. Under the Bankruptcy Code, earnings from personal services you perform after the date you file the Bankruptcy Petition are yours, and the trustee has no claim on them. If you had begun the job before the date of filing, of course, you would have to report it on the Bankruptcy schedules-but that is not the situation you set out in your question.
