Can I sue a bank for delay?

More details to this question:
I bought a property at bank auction. In the contract it states TIME IS OF THE ESSENCE, CLOSING IS NOW 5 WEEKS PAST CLOSING DATE POSTED. Can I sue them for the delay? Thanks.
