I filed a Chapter 7 in the state of Florida, but I was told that I had to utilize my previous state's exemptions since I have not been a residence for 2 years in the state of Florida. Even though I have not been a resident of a single state, I was told that the 180 day rule would not apply even though I have been in Florida for about 1 year and half. I have not met the actual attorney I am paying, but yet the assistant attorney is not providing representation. I do not trust him or the trustee. My attorney did not even exempt any portion of my tax return when the state's exemptions had them. When I told him about this, he contacted me and advised me he knew them and amending my case would be no problem. He is supposed to have my best interest at heart and he doesn't or he would have done this. I feel like I am being crooked by the trustee and the attorney. I have addressed my concerns to the head attorney of the firm and no reply. I believe the trustee was a racist and he didn't ask everyone else to supply their tax returns when it was put in writing that's what he needed to conclude your case. That wasn't so for some of us. I am sure you understand what I am stating. What can I do? I want to hire a new attorney and refile in the actual state whose exemptions I am supposed to use. I have been in Florida from 10/11 through 01/12. I was in the other state from 01/12 - 06/12. From then on I have been in Florida ever since. Please tell me what I need to do. I am paying almost $1800 and no representation at all. The whole focus was just on my income tax return that was filed after the Chapter 7. Please tell me what to do to get out of this situation and to prevent from being taken advantage of.
