Can my car be modified into the 13?

More details to this question:
I am currently in a 13 and I also filed a 7 that is discharged. Iโ€™m in the 13 for ticket but now I need to put my car in the 13 due to loss of income and illness.

Your question is not quite clear. So it is impossible to answer, In most federal districts you would be held to your original plan, and your way to get out of the car debt would be to convert to a chapter 7. But for now you cannot earn a discharge on Ch, 7. You may well be stuck with this unwelcome debt. Consult a skilled BR lawyer in your local; it's almost Alexus worth the investment.

I would need more particulars to answer your question. Can't you go back to your CH13 attorney with your questions? If not, you will have to pay an experienced attorney to review your file with you to explain your options.

Using the term MODIFIED is confusing. You can make your vehicle payments in your Chapter 13, and change some of the terms, like the interest rate or number of payments to lower your vehicle payment. In Chapter 13, MODIFY has a particular connotation apart from changing the terms described above which requires that you own the vehicle for more than 910 days. In order to implement this process, called the 910 rule, you will need experienced representation.

If the car was purchased before you filed the 13, you can ask the court to modify the plan. The issues of what's best for you and the interests of the creditors will be what the judge will base the decision on.
