QUESTION

Can my house be foreclosed on with no notice?

Asked on Mar 14th, 2013 on Foreclosures - Washington
More details to this question:
The city called yesterday to let us know our house was foreclosed and sold the day before. We had no knowledge of this. In Sept/Oct, we got a default letter sent to my parents house (we lived there previously) but my husband got that taken care of. My husband was going to be late in January and called the bank and they made no mention of our house getting foreclosed on. And they accepted the payment. Can they really foreclose on our house without us knowing? We received no letters to the house (they claim they sent a bunch), no phone calls from anyone (again, they claimed they made calls), and no one ever came to our door. Can they do that? Are we screwed now because the house has all ready been sold?

All you can do now is sue the bank for wrongful foreclosure.

You were supposed to have received the notice of the default and notice of the trustee sale. Unless you do not live in the property, it would be difficult to argue to court you were not aware. Generally the notice of trustee's sale is photographed on your property after it is posted.

Yes, you can contest the sale, but you need to act immediately. You must bring a wrongful foreclosure action in court. The sooner you act the better. You should contact a lawyer.
