QUESTION

Can one file for bankruptcy from overseas?

Asked on Nov 04th, 2013 on Bankruptcy - Florida
More details to this question:
I am stationed in Germany since 2009 as a civilian working for the DOD. Due to a divorce, my home in Orlando went into foreclosure 2 weeks ago. Can I file for bankruptcy from Germany and does it have to be in Florida if I have not been there in the past 180 days? Does this type of bankruptcy require the services of a "special" lawyer?

You need to contact a bankruptcy attorney in the Orlando area. I have not addressed this precise issue in over 25 years of doing bankruptcies, but believe that you should be able to file in Orlando, if it is your home and permanent residence, and you intend to return and have family or community ties there. The problem as I see it is that you will be required to attend a meeting of creditors, in person. It might be easier to find out if there is a better place to file bankruptcy where you are.
