QUESTION

Can the mortgage company foreclose on us still?

Asked on Jul 27th, 2013 on Foreclosures - New Jersey
More details to this question:
4 yrs ago, me and my husband both lost our jobs within 2 mo of each other. I called the mortgage company and asked for help. They told us for the past 4 yrs they could help us. Now I find out they put my mortgage on the empty lot instead of our home. And because they would not take any money what so ever from us it put us over 40 thousand behind and we just had to file bankrupts because of it.

Before foreclosing, the mortgage company must correct the error on the collateralization. The bankruptcy should have discharged your personal obligation to pay but did not release the lien on the secured parcel.
