Can two different companies garnish you at the same time?

I am also in the process of bankruptcy and is currently being garnished now and another one just came up.

Sometimes two different creditors will send garnishment paperwork to your employer at the same time, but state exemptions and labor laws limit the amount that can be taken to a maximum of 25%. Typically, the paperwork that arrived first will be the only one paid and the second one will have to lay in wait.

If you have filed for bankruptcy, unless they have relief from stay, no garnishment can take place at ALL.

The answer depends on the law of your state, and also the practices of the trial courts in your county. The general opinion among lawyers in Wisconsin is that a person can be subject to only one garnishment at a time. It cannot hurt to consult an experienced local lawyer in your area. You might want to consider a bankruptcy, which often saves you lots of stress. It carries some costs, of course, but most of my bankruptcy clients report a great easing of their minds. Finding a good lawyer is almost always worth the investment.

Typically, there is a statutory limit on the amount that can be garnished, so usually the first creditor takes the maximum allowed and the second creditor has to wait. But there are a lot of variables and you should talk to an attorney for the simple reason that they can often recover a lot of the garnishment for you.
