More details to this question:
My chapter-13 is paid off just waiting for the trustee to distribute the last payment, he mentioned that the next step would be that the clerk's office will send me to mail out a Certification to the debtor (or debtors in a joint case) (this is the last – and very important – step debtors must pay attention to and be sure to get done right away. In that Certification, each debtor must answer a set of standard questions about certain things under oath (and under penalty of perjury). The most important thing for you is to complete and return that Certification to the Clerk; if that’s not done, the court will close the case without granting a discharge (which is one of the main reasons you filed your case in the first place). if you have any questions about the Certification, the questions you’ll be asked to answer talk with the attorney.! Is this normal procedure?
Yes, this is part of the Motion For Entry of Discharge. Your Chapter 13 attorney can help you get this filed. Contact your attorney. Typically you will be mailed the forms to complete and file with the Court and you can do this yourself if you no longer have an attorney.
This is general legal advice only. You do not have an attorney-client relationship with Attorney Lynn E. Coleman without a signed retainer agreement and payment of any applicable fees.
