I have filed charter 7 in 2006. I have filed chapter 13 with my new husband in 2009 with the same lawyer because our morgage company was trying to forcloused on our house. the company was trying to go after me even through my name is not on any of the paperwork for the morgage. Now the court has dismiss my bankruptcy because I did not show up and I had filed in 2006. I called his office and was told by his legal aid I did not have to go to court but I can not get my lawyer to contact me back. I make appointments and he is struck in court. Who do I need to go to take action about this?
This is not something that can be analyzed on the internet. If your attorney is not responding to you, you should file a complaint with the state bar, and find a new attorney immediately to protect your rights.
If you received a discharge in your 2006 bankruptcy case, then you were not eligible to receive a discharge in your 2009 case, but there's nothing wrong with you doing a repayment plan in the CHapter 13 anyway. You don't say when your case was dismissed, so I don't know whether it occurred 3 years ago, or yesterday or what the status of curing your mortgage arrears are, etc.
