Does a personal representative hold the same rights as a decedent?

More details to this question:
The mortgage company will not give me a modification and they have all of the legal documents on file. They will not let me assume the mortgage and have given me the run around for a total of five years. (Wells Fargo)

Unfortunately, you typcically can't "assume" the mortgage if the lender wont agree. If you are a PR you should really address these questions to your probate attorney handling that matter.
