QUESTION

Does our organization liable for payment?

Asked on Sep 25th, 2013 on Bankruptcy - Louisiana
More details to this question:
My nonprofit youth group purchased some copies, flyers and raffle tickets from a parent in the organization back in 2011. The company that this parent worked for is now threatening to sue for nonpayment. We never signed a contract with the company, never signed receipt of the copies or received an invoice for said work by mail or other. Our contact information was on the items. Payment was made by check to the individual parent not company.

This is a case of fraud. Since you received the work done, you are in a spot. However, the question is did the parent have authority to bind you with the company she works for? The answer is no, and if you paid her for work she provided you need not pay the company.
