Does VA disability count as income for Chapter 7 bankruptcy?

More details to this question:
I am in the process of filing for chapter 7 bankruptcy, and my lawyers are telling me my husbands VA disability counts as income. This doesn't seem right as we don't pay taxes on it nor do we have to claim it when we file our taxes.

Yes it counts as income on both the means test and on your current income/expense test.
