How can I file bankruptcy on disability?

More details to this question:
I do not have the funds to pay a lawyer for bankruptcy. I owned two business in 2006 and they both fell due to the economy. I ended up with several credit card debts. I became disabled in 2011 and have recently received a debt collection notice from the IRS stating I had to include that on my income. I have filed a form trying to prove I have no income to pay this but seems I am going to be put on a payment arrangement with them for these two debtors. I am still receiving other bills from credit card company banks. Will these go to the IRS as well? There is no way with my monthly disability pay I can pay it. Is there any help with bankruptcy filing fees if you are receiving disability pay?

Yes. You can file a chapter 7 bankruptcy and discharge the unsecured debts. You will still be liable for the taxes.

You can apply for either a waiver of the filing fee or to make the payment in installments. When it comes to fees for an attorney or preparer that would of course be a matter to discuss with them.

There are a lot of questions here. First, you can file bankruptcy no matter what the source of your income and as long as you earn less then the median amount for this region I think that's like $65,000 you qualify for Chapter 7. However IRS is non-dischargeable so you will have to pay them. And they MIGHT not continue to work with you if you do file you should call them and ask. You can ask the BR court to waive filing fees. All the other bills should be dischargeable.

You need to consult with a bankruptcy attorney. Filing fees can be waived by the Bankruptcy Court.

Check with your county bar association and ask for a pro bono attorney. Also you can file it without an attorney and even request a waiver of the filing fee. Additionally some of the law schools have legal clinics.
