QUESTION

How can I remove a lien on a home that I previously own?

Asked on Nov 16th, 2012 on Bankruptcy - Florida
More details to this question:
I got a discharge back in 2008 where I settled at 50% of debt. I sold my home prior to the bankruptcy to a relative so the trustee stated I transfer the property. Nevertheless, now there is a lien on my brother house, which was previously mine. Is there any right to do that seeing that this was already paid?

The debt is discharged, but the lien remains unless you bring a motion to remove it. You may have to re-open the estate.

Although you now have little leverage, you may contact the lien holder to see if they will voluntarily release the lien as part of your original settlement. If the party that purchased your home obtained title insurance, this also could be a matter settled through an insurance claim.
