You should have received a copy of the garnishment. If you did not, check with your employer as to who is garnishing your wages. If it as a result of a judgment, your could challenge the garnishment if you do not owe the money. If you owe the money, you might want to challenge the garnishment and at the same time, file a motion for installment payments. Installment payments will allow you to seek relief from the court in the form of a monthly payment agreed upon by you and creditor or set by the court. As long as you maintain the monthly payments, there can be no wage garnishment.

You need to find out who is garnishing your wages and why. Normally a judgment and court order is required, but not always depending on the nature of the debt. Once you know who is garnishing your wages and why, contact an attorney to fight your garnishment.

Find out from your employer who is garnishing the paycheck. You likely have a default judgment against you that you are unaware of. After you know who is garnishing it, you can move to set aside the default in the underlying court case, or assert certain exemptions. If you are supporting children, you may wish to look into the head of household exemption.

Find out what Court issued it and go to that court and get copies of the paperwork, and then take it to a lawyer.

After the garnishment commences you should receive papers explaining on whose behalf and why. Take and review them with an attorney.
