My home was foreclosed in 2000 and sold a few months after the fact. This is still showing on my public record for the full amount. Can the mortgage company do this?

That depends on what you mean by a "public record." Derogatory information on your *credit report* should be deleted after seven years after the last transaction on the account took place - in this case, the foreclosure. If it is a credit report, simply write the credit reporting agency and they have a thirty day window to respond to your complaint or remove the offending information under the federal Fair Credit Reporting Act.

It is a final judgment against you and will be on the public record forever. The mortgage company did not do this. It is the law. They merely foreclosed on you and got the property put into their name and then sold it. They apparently did not seek a deficiency judgment, and you should be glad that they did not. Judgments in Florida are good for 20 years if they are recorded properly.

Typically it should've fallen off by now. You can contact the credit bureaus to request it to be taken off your credit report as it's not valid at this point.

It is supposed to seven years maximum, though it can be extended up to 10 years when there has been a judgment.
