QUESTION

How long should the final decree take?

Asked on Apr 08th, 2017 on Bankruptcy - Nevada
More details to this question:
I forgot to list a creditor and I noticed it two days before discharge. I had a few thousand dollar worth of assets that they say I have to pay because I had given to my family within the last year. Since it was an asset case, my understanding is it’s a good thing I noticed prior to the discharge. My credit shows the debt and it says chapter 7 under comments, so I am assuming they know. Besides that, they stopped contacting me with all of that information if It safe to assume that the discharge deadline will move. If so, does it move for all creditors or just for them? Also side note, I had no government debt so will my assets be distributed on the 30-day deadline for creditors to file asset documents, or will my case be 6 months due to the possibility of government?

While your question is not entirely clear, you can usually add a creditor just before discharge or even for a reasonable time afterward. The Trustee has a good long time to assemble the assets and pay them out. It could take as much as two years. It makes sense to amend your schedule is to include this newly discovered creditor very soon period.

This type of problem is the reason people retain an attorney to represent them in bankruptcy. Unfortunately, unless you know the clerk of the court where your bankruptcy was filed, it is impossible for me to say whether the clerk will delay your discharge or not. But if your discharge is delayed, it will be delayed for all your creditors. As to distribution of assets, regardless of the type of debt you have, expect the process to be slow.
