How often can you file bankruptcy?

More details to this question:
My husband and I think that it would be in our best interest to file bankruptcy for a second time. This was never our plan but with him being out of work for a while a couple years ago, things are just not getting back on track. We would like to know when we can do this?

It is going to depend on the chapter you previously filed under and the chapter you intend to file under at this time. For example, if you previously filed a Chapter 7 and now intend to file and qualify for a Chapter 7 you will have to wait a period of eight years from the date of the first filing to file again. There is a lesser waiting period if your intent is to file a Chapter 13 at this time. If your first case was a Chapter 13 and you now intend to file a Chapter 7 you would be looking at a waiting period of years. There are other periods that may also be applicable and I would recommend that you schedule an appointment to discuss the matter in detail with a local attorney.
