QUESTION

How to get lien off property after chapter 7?

Asked on Dec 05th, 2012 on Bankruptcy - Colorado
More details to this question:
I have a property in Atlanta that I surrendered to the lender in a chapter 7. It has been 2 years and they still haven't foreclosed due to me being active military. I figured I would try and sell the property for the taxes owed but cannot get them to release the lien. The lender said they have interest in the property but won't pursue until I am out of the military, which I don't plan to leave. What can I do to either get them to foreclose or have them take the lien off?

Ask them to take a deed in lieu of foreclosure. They might do that.

You can try a short sale through a local Realtor, but many others have found that when you want a foreclosure to take place, there is little you can do to make it happen.

You could try to see whether they will accept the deed back from you in lieu of foreclosure.
