i want to have my name removed have not live there since 2006 but am unable to refinance the home. This home is spiking my debt to income I only make 33K a year, and its killing my credit score due to the the chapter 13 filing on his behalf. I want to file chapter 7 but will i be able to keep my car.
Whether you can keep your car, or any assets, in a chapter 7 case depends on the the value of your vehicle, the amount of equity in it, and the applicable exemptions laws of whatever state applies in your case.
Exemptions are "protections" for value you have in certain assets such that they are "exempt" from collections. Every state has different exemptions amounts available. Exemption laws are based on the state where you resided for the 2 years prior to filing your bankruptcy case or, if you lived in more than 1 state during that period, in the state where you resided for the greater part of the 180 days prior to that 2 year period.
