Is it illegal to sell a home in foreclosure?

I signed a contract to lease with option to purchase a home. We were required to make payments directly to mortgage holders and all info was provided by owner (owner-financing). The owner was three months behing and forclosure notice was served to us as unknown tenant. This was in Volusia County. The owner has since filed suit against me for back "rent" and alleged damages.
