QUESTION

Is VA Disability included in disposable income test?

Asked on Oct 15th, 2013 on Bankruptcy - Texas
More details to this question:
I filed bankruptcy in Texas - it was automatic CH13 100% payback. My son and I live in poverty now. I am 80% disabled retired veteran of US Army. If the test does not include VA disability I qualify Ch 7. Can VA disability be used in disposable income test? I say it cannot, just like SS - even in TX it is covered under 11 USC. I need citations etc. My disability is from results of active duty but not in war. Bad vaccine made very ill and general wear and tear. Just did physical, they cannot fix disabilities and nothing has improved after 10 years. Massive headaches joint pain etc. similar to gulf war syndrome.

Yes, in general, VA disability payments will not be counted in a Means Test. You should be okay.
