I have been divorced for almost a year. At that time, my ex took most of the community debt and I agreed not to ask for spousal support or ยฝ of his retirement. The judge did reserve jurisdiction on the spousal support so I filed for it last week after I found my ex has filed for bankruptcy. Now the creditors are after me and holding me liable which I understand is legal. I canโt afford all the debt and I am not sure about the spousal support because I am living with my boyfriend.

Yes, if your husband filed for bankruptcy on a joint debt, you (the co-debtor) will be liable for the full balance. If you cannot afford to pay the debt, you should definitely consider filing for bankruptcy.

The family law order as to payment of community debts is enforceable against your ex spouse. You will have to seek a family court order to enforce this. Alternatively, you might want to consider filing bankruptcy. Consult with an attorney in this regard.

Bankruptcy may be a good solution to wipe out debt owed to creditors. Bankruptcy does not remove or eliminate domestic support obligations, however.

You need to stop guessing and sit down with your lawyer. Your illegal relationship probably eliminates alimony, and the fact that you do not understand that he cannot discharge marital debt in bankruptcy shows how badly you have fared by winging things. Get a lawyer to protect your interests.
