QUESTION

Should I file for bankruptcy? How?

Asked on Jul 18th, 2013 on Bankruptcy - Florida
More details to this question:
I just found out that my wages are being garnished by Target National Bank, the lawyer that is in charge of this is Michale. I was never notified that this would take place. My question is, I just pulled up my credit report from Experian, Equifax, and TransUnion and Target National Bank isn't even listed. Shouldn't it be listed and if I do bankruptcy will I be able to stop the garnishing of my wages and also get back what they have taken?

Bankruptcy will stop the garnishment, but you normally do not get the funds that have been paid to the creditor.

Whether a debt is or isn't on your credit report has nothing to do with whether you legally owe the debt. Whether you should or shouldn't file bankruptcy will depend on your overall financial picture, not on one debt. If you do file bankruptcy, the wage garnishment will stop, but any money that has already been taken cannot be returned to you.

Credit reports only list debts that creditors choose to report to the credit reporting agencies. Creditors are not required by law to report debts owed to them, they are just required to report accurate information if they do choose to report. If you file bankruptcy, the garnishments will stop. But, no, you will not get back the money they have already taken. You should meet with an experienced bankruptcy attorney as soon as possible so you can learn about your options and determine whether bankruptcy is your best course of action.

It's very rare to get back what's already been taken unless it's in an intermediate holding place (like Sheriff still has it). However, you will stop the garnishment by filing for bk.

Target National Bank is the lender for Target stores; you likely have a Target credit card. Often a garnishment is a surprise. You may file Chap. 7 bankruptcy and stop the garnishment but you will not get back what funds have been taken. So prompt filing is necessary but bankruptcy must be properly prepared, complete, and the benefits and disadvantages considered. May this information help you to make decisions involving legal issues.
