Should my ex husband file bankruptcy?

He has an 8 year prison sentence and is wondering if bankruptcy is necessary.

I assume that he's hidden all his prepaid cell phones, so how exactly will his creditors collect from him? Unless he has assets that would be protected in the bankruptcy, I don't see where it would be any benefit to him.

Unless your husband has assets, it might make no sense for him to file bankruptcy. Any court ordered restitution will likely be ineligible to be discharged under 11 USC sec 523. What type of debts he has and whether there are any court judgments against him could be additional considerations in making a decision about whether to proceed with any bankruptcy.
