QUESTION

Tenant filed chapter 7

Asked on Feb 27th, 2016 on Bankruptcy - Michigan
More details to this question:
I served a 7 day quit December 10th. Tenant did not pay or move. Filed for pocession and was granted pocession by Rochester court Michigan where tenant was to pay arrears or be moved by Feb 18th. Tenant filed chapter 7 on Feb 18th. The first name on the filing is incorrect. I believe she provided me with fraudulent income and not all her credit information on the application. She was short at move in signing a promisary note for the balance and hasnt paid a penny since. Zero reponce from her since. Another creditor found me and says she claimed an additional $800 a week income that did not appear on my application. After filing chapter 7 she opened a LLC which refers to the source of the $800 income claimed by the other creditor and got a new credit card with that company name with her the soul owner. Do I have a case of fraud or misfilings due to the incorrect name on the filing document? What can I do? I am a Private owner and landlord.

Unless she owes you a ton of money, it will not be worth pursuing. Take all of your information and the amount she owes you to a good bankruptcy attorney to get a view as to cost and likelihood of success. Good Luck.
