What happens if I cannot pay my bankruptcy payments?

I will not be able to pay my first bankruptcy payment. What should I do?

If you file a chapter 13 plan and can't make the payment you might want to convert to chapter 7. You also can modify the plan so the payment is lower.

Call your lawyer (you didn't make the catastrophic mistake of filing pro se, did you?) to determine if your case can be salvaged.

Your case will be dismissed. Ch 13 is difficult. You have to make the payments for either 3 or 5 years EVERY SINGLE MONTH. If you cannot make the payments the case will be dismissed. You have about three months of missed payments before that happens. If your income is so low you cannot make the 13 payments, why are you in a Ch 13? In my experience, many ill-advised 13s are an attempt to save house, where there is no equity and the mortgage structure does not make sense. Convert to a 7, let the house go, rent whatever housing you can actually afford.

If you are unable to make your Chapter 13 plan payments, your case will eventually get dismissed for non-payment. If you find yourself unable to make your plan payments, you should speak to a knowledgeable bankruptcy attorney about your options such as restructuring your plan or converting from a Chapter 13 Bankruptcy to Chapter 7.

If you are in a Chapter 13 and cannot make your payments then case will be dismissed. You can dismiss it voluntarily or convert it to a Chapter 7 case if you are eligible.

If you are in Chapter 13 it will be dismissed. Before then, see if you want to convert to Chapter 7. Speak to a lawyer ASAP. You can also talk to the trustee if the delay will be a week or so.

If you fail to make your bankruptcy filing fees your case will be dismissed. If you miss an installment payment you should be able to make it up in the next month.
