What should be done if I am going to be late on my first chapter 13 payment?

We donโ€™t get paid for call off days. Paychecks have been short.

Sort of depends on how late your payment is. Under a few weeks, no problem. More than a month, big problem. You may need to review your budget and submit another plan for confirmation if you cannot afford to make your Plan payments on time every month.

Your really should be asking your attorney, but basically you need to show the judge you can afford a chapter 13. You need to do whatever possible to make that payment on time.

In Oregon, it is okay if you are late on the payment to the Trustee, as long as you pay it by the end of the month.

Your lawyer and you should have one or in the lack of a lawyer, then your self should call the trustee, find the legal assistant who is looking after your case (have your case number at hand) and to hold him or her that you will be making only a partial payment this month, but you will try to make it up in the following month.

Pay as much as you can on your 1st payment, and catch up on the 2nd payment.
