QUESTION

Why can’t I cancel an online success strategy course?

Asked on May 21st, 2014 on Bankruptcy - Illinois
More details to this question:
I attended a seminar a month ago. The program was $3300. I couldn't afford to pay it in a lump sum so they took my information down and said they will call me if they can work something out. They called and I signed up on the 9th of May. On the 19th, I called them back to cancel because the surgery for my hand was pushed up. I had surgery on the 15th of May. I had to sign up for worker’s compensation. It can take anywhere from 2-4 weeks before I will get an answer so I want have an income coming in. They told me I only had 3 days to cancel. I said at the seminar they said you can cancel at any time with a full refund. They said they said nothing they can do because it’s after the 3days. I only had it for 10 days. I didn't ask for a refund. I just want to cancel so I won’t be liable and they want mess up my credit.

Generally, you need to be very careful when signing a contract. If you are told there is a right to cancel, ask to see it in the contract. In Illinois, there is a three-day right of rescission if an installment agreement offer is solicited (a door-to-door sale) and there are rights of rescission for a couple specific types of contracts, but generally contracts are binding. Here, there may be some arguments an attorney could try on your behalf, but there is no doubt that an attorney would look to be paid hourly to defend collection of your obligation. With a company like you describe, another question would be whether the attorney general's office would take a look at their conduct (perhaps there are already similar reports) or whether there would be some basis for a class-action attorney to think that enough people have been hurt by improper tactics or a scam.

Have a lawyer review the documents you signed/ received to see if they comply with all legal requirements and disclosures. Cancellation periods generally begin when the requirements are complied with.
