If you're even asking this question, stop and forget about it right now. Yes the trustee will most likely find out about any inheritance or transactions for a 401(k), these are all electronically registered somewhere in the trustee has access. Never try to hide anything from the bankruptcy trustee or the bankruptcy court. There are jail terms associated with such behavior and it's not a state penitentiary your talking about federal prison. Don't even consider any course of action that breaks federal bankruptcy laws. I have responded to your inquiry according to the laws of Massachusetts, where my firm is located. Laws can vary significantly from state to state and cases tend to be rather fact-specific, so you are best served by consulting with a knowledgeable attorney in weighing your options.
