If you owe money for an overdrawn bank account it can be discharged in bankruptcy. However, owing this can cause you to have problems getting a checking account. If you are overdrawn you should pay it so this doesn't happen.
Not necessarily, if you have an attorney have him call them for you and advocate on your behalf that they remove your name and info. I have done this successfully for my clients.
