My car was repossessed last week. We're behind on payments but I read that if we include the past payments in our chapter 13, we can get the car back.

As long as the redemption period hasn't ended, you can get the car back.

You've got to be really quick about it. Vehicles go to auction very soon after they are seized.

That is likely but there are differences between the bankruptcy court's local practices in the 94 federal districts. You should consult an experienced bankruptcy lawyer in your locality.

Yes. You will need to prove that the car is insured before they have to give it back to you.

Yes, that is a strategy that works, but you need to consider that Chapter 13 is an expensive program and may cost you more than getting another vehicle. And you also need to consider whether you will be able to faithfully make plan payments or will be unable to keep up payments only to lose the car again.

Filing a chapter 13 would be a way to get your car back and get caught up on payments (and pay the vehicle off).

Generally, you can recover the vehicle and reorganize the missed payments via Chapter 13.
