Advice of suing a furn co for furn bought a yr ago but have yet to rec it due to the co wanting us to pay for another delivery fee.

The delivery driver called minutes before coming that he was 10 min out we asked him to give us about 30 min but he refused and cancelled our delivery. Then the furn co wanted to charge another delivery fee but we feel the driver unfairly did not work with us to deliver and we still had the "window" of delivery within the 30 min we asked for. The furn co still has the furniture we bought, and our money for about a yr now. Recently called us to say we owed a "balance" we have our receipt that show PIF; we know we can go to small claims. Do you advise we have an attorney instead so we may sue for our FULL payment be returned plus interest from the company holding our money even after we sent a returned recpt letter for our money back?
