Asked on Nov 06th, 2012 on Business Law - California
More details to this question:
I found a white plastic material in a burrito bought from my works cafeteria. I started to eat and swallow my burrito when something touched my uvula and I immediately started choking. I spit out what was in my mouse. When searching through the spit product I found a 1 to 2 inch piece of plastic. All this happened at my work while in a cubicle at Chase Home Lending in San Diego CA 92027.

You cannot obtain a monetary recovery for a defective product that caused you no injury. Moreover, if you are injured while on the job, your recovery is limited to workers compensation. While you had an unpleasant experience, you did not suffer any legally recognized harm beyond what you paid for the "defective" lunch.
