QUESTION

Am I still under a NDA?

Asked on Aug 23rd, 2013 on Business Law - Virginia
More details to this question:
When I signed an employment agreement 11 years ago the agreement was with X company. The company has been sold twice in the past 8 years and has gone from X Company to Y Company to Z company. I have not been asked to sign an NDA under either Y or Z company. Am I still bound by the original NDA which was under X company? Does it xfer automatically to Y and Z company?

It really depends on what the NDA says about being assigned to successors.  If it is silent on assignability, then you might not still be liable.  But if it says that it can be assigned to successors, then it probably transfers to each new company.
