my name is Jr and I live in fort worth Texas and I put in my 2 weeks notice at my old job and worked those entire 2 weeks. My last day was Thursday September 6 which was the week of labor day. I found out when I received my last check that I did not get paid for the holiday since I didn't work that Friday September 7. I know that that the company guidelines state in order to get paid for holiday the employee must work entire week before and after. I want to know if they can not pay me for labor even though my work final day of my 2 weeks notice was that Thursday September 6?
As a general matter, an employer has no duty to compensate employees for holidays not worked. This means, for example, that the law does not require an employer to give employees compensated time off, including for vacations, public holidays or otherwise. If an employer does pay for holidays, it may generally set the terms and conditions on which it will do so. If you have been paid for the days you actually worked, then your employer has discharged its duty to you.
