can i sue chipotle for not hiring me. The person who called elluded to the reason that i was not hired was due to the fact I have a masters degree.

When he said "it wasn''t in their best interest" to hire me. Also adding it wasn''t "in my best interest to be hired". I have 2.5 years kitchen and management experience. I have a bsed in education and an msed in adapted physical education.
The store is brand new and looking to open with a new staff. I was asked to interview 18 hours after applying, and told that i was exactly what they were looking for and even told me how much to ask for for a salary and which position he wanted me to take. I even told him i had another interview in 2 hours with sears and he said "don''t even bother going to it." I was then brough back for a second interview 6 hours later. A week later i had a third interview. I was told i would get a call back in an hour. 2.5 hours later i get the call they weren''t going to hire me. Is this something i can bring to court. Luckily I went to the sears interview and they offered me a part time job instead of the full time job chipotle promised at 10/hr
Your facts do not set forth a legally cognizable cause of action. It is perfectly acceptable for an employer to refuse to hire a job candidate because the candidate is overeducated. In any event, even if they had hired you, they would have been privileged to fire you the next day, because employment in New York is on an at-will basis.
