QUESTION

Can u be regatnished for the same wage garnishment?

Asked on Jul 31st, 2012 on Business Law - Alabama
More details to this question:
I was garnished last year for a involuntarily repo from 2004 the lawyer handling the case never served me any papers. I found out I was being garnished only when funds was taken from my payroll at work. The garnishment took 25% of my check for 6 months then ended. Last week I find out they garnishing Me again for the same car loan. How are they able to do this? Seems statue of limitations would prevent it being resubmitted. I moved out of state since last garnishment. The lawyer handling case didn''t even know where I lived she asked me my address and told me address on my credit report was incorrect. This garnishment is messing me up with bills and my rent for my apt I need advice from a lawyer I''m what I can do. Fl lawyers all say file bankruptcy but I have good credit now and don''t want it ruined over a 8 almost 9 year old reposession. Plus the new garnishment they aren''t even including the almost 3000 I paid from first garnishment they still say I owe 10,000

As a general matter, the statute of limitations for collection of a judgment for an unpaid debt is 20 years or so. The creditor can generally continue efforts to collect it until it is paid in full. Your inquiry does not suggest that you not owe the money or that the debt is invalid in any way. The advice you have received appears correct -- file for bankruptcy, make payment arrangements with the creditor, or just pay it.
