If I went to my obgyn in January because I have not received my period and I did take pregnancy test but they all came out neg. He told me that the reason why is because I''m stress, over work and not eating. When I went back to him in May because I never had this problem before he said I was 7 months pregnant. When I saw him in January he did not take blood from me and it was the first time I ever went to him. He did not do another pregnancy text either. Do I have a case?
The answer is "possibly." The mere fact that the physician's advice turned out to be wrong does not constitute malpractice. If a reasonable physician in the same circumstances complying with the community standard of care would not have performed a pregnancy test, then he is not liable for failing to do so.
